第六条 双方权利和义务
1、甲方权利和义务：
（1）甲方有权根据合同监督检查乙方日常植物养护管理工作。同时，甲方应督促所有人员爱护植物，及时制止和处理损坏和偷窃植物的行为。
（2）甲方负责免费提供植物养护所需用水、植物临时保养场地和工具存放间。
（3）在乙方进行日常养护期间，协调乙方工作人员与甲方所有相关部门和人员之间的关系，保证植物日常养护顺利进行。
（4）按合同约定及时足额向乙方支付养护费用。
2、乙方权利和义务：
（1）乙方应根据本合同约定，严格按甲方要求摆设植物，并安排专人负责植物的养护管理，包括：日常浇水、施肥、修剪、防治病虫害等，保证植物处于良好生长状态，保持良好观赏效果。
（2）乙方工作人员应穿着工作服、佩戴工作证进场工作，工作服应整齐干净。乙方工作人员工作期间应遵守甲方的所有管理规定，不得做出任何影响甲方办公的行为和其他不良行为。
（3）如甲方检查发现植物养护质量等未达到双方的要求，乙方应在收到甲方书面通知后3个工作日内予以整改。对已出现残像、观赏效果差的植物，乙方应及时予以无偿同价更换。
（4）乙方应负责其工作人员的劳动保护和人身安全。在履行本合同过程中，因乙方工作人员自身原因造成他人或自身的人身、财产安全损害的，责任由乙方负责。
第七条 违约责任
1、乙方未按合同约定履行相关义务的，应按合同总价款的30%支付违约金。
2、甲无正当理由单方面终止合同，应按合同总价款的30%支付违约金。
第八条 合同争议的解决
在本合同的签订、履行过程中发生争议的，双方应当本着友好、协作的精神进行协商，协商不成的，双方可提请广州市仲裁委员会仲裁解决。
第九条 附则
1、本合同如有未尽事宜，双方可订立书面补充协议，补充协议视为本合同的有效组成部分。

七、协议变更与终止
1、协议的变更：本协议在履行过程中，如需要修改，须经双方协商同意并以书面形式形成本协议的附件。
